By accessing or using TryOn API ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Service Description

TryOn API provides virtual try-on services using advanced AI technology including 3D modeling and artificial intelligence. The Service enables:

• Visualization of clothing and accessories on uploaded images
• API access for programmatic integration
• Real-time processing with multiple AI providers
• Credit-based usage system

3. User Accounts

3.1 Account Creation

• You must provide accurate and complete information
• You are responsible for maintaining account security
• You must notify us immediately of any unauthorized access
• One person or entity per account unless otherwise agreed

3.2 Account Types

• Demo Account: Limited free access for testing
• Developer Account: Full API access with credit-based billing
• Enterprise Account: Custom terms available on request

4. Acceptable Use

4.1 You May:

• Use the Service for lawful commercial and personal purposes
• Integrate our API into your applications
• Upload appropriate images for virtual try-on processing

4.2 You May Not:

• Upload illegal, offensive, or inappropriate content
• Attempt to reverse engineer or copy our technology
• Resell or sublicense the Service without permission
• Use the Service to create deepfakes or misleading content
• Exceed rate limits or abuse the Service
• Upload images of individuals without their consent

5. Intellectual Property

5.1 Our Property

All technology, algorithms, and Service components remain our exclusive property. You receive a limited, revocable, non-exclusive license to use the Service according to these Terms.

5.2 Your Content

You retain ownership of images you upload. By using the Service, you grant us a non-exclusive, worldwide license to:

• Process your images to provide the Service
• Store images temporarily as needed for processing
• Generate and deliver try-on results

5.3 Generated Content

AI-generated try-on results are provided for your use. You may use these results in accordance with these Terms and applicable law.

6. Payment and Billing

6.1 Credit System

• Services are billed using a credit system
• Credits are purchased in advance
• Different operations consume different credit amounts
• Unused credits may expire according to your plan terms

6.2 Pricing

• Current pricing is available on our pricing page
• Prices may change with 30 days notice
• Changes don't affect pre-purchased credits

6.3 Refunds

• Credits are non-refundable except as required by law
• System errors resulting in failed processing will be credited back
• User errors (invalid images, etc.) are not eligible for refunds

Your use of the Service is subject to our Privacy Policy. Key points:

• Uploaded images are processed securely
• Images are deleted after processing (within 24 hours)
• We don't use your images to train our models without consent
• Results are stored temporarily (30 days) unless deleted

9. API Usage

9.1 API Keys

• Keep API keys secure and confidential
• Don't share keys or embed them in client-side code
• Rotate keys regularly for security
• Report compromised keys immediately

9.2 Rate Limits

• Respect published rate limits
• Implement proper error handling and backoff
• Contact us for higher limits if needed

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Service is provided "as is" without warranties
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid in the last 12 months
• We are not responsible for third-party services or content

11. Indemnification

You agree to indemnify and hold us harmless from claims arising from:

• Your use of the Service
• Violation of these Terms
• Infringement of third-party rights
• Your uploaded content

12. Termination

12.1 By You

You may terminate your account at any time through the dashboard. Unused credits are non-refundable.

12.2 By Us

We may suspend or terminate your account for:

• Violation of these Terms
• Suspicious or fraudulent activity
• Non-payment
• Extended inactivity

13. Changes to Service

We may modify or discontinue the Service with notice. We will:

• Provide 30 days notice for major changes
• Allow you to export your data
• Honor pre-purchased credits or provide refunds

14. Dispute Resolution

14.1 Informal Resolution

Contact us at legal@tryon-api.com to resolve disputes informally.

14.2 Formal Resolution

If informal resolution fails, disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

15. General Terms

15.1 Governing Law

These Terms are governed by the laws of the United States and the State of California.

15.2 Entire Agreement

These Terms constitute the entire agreement between you and TryOn API.

15.3 Severability

If any provision is found unenforceable, the remaining provisions will continue in effect.

15.4 Assignment

You may not assign these Terms without our consent. We may assign our rights and obligations.
